Please be advised that these Conditions of Sale are only applicable to orders placed through the website www.marcocruzjoalheiro.com (the "Website") and do not apply to sales made through other sales channels.

The Website is an authorized online reseller of Marco Cruz Joalheiro. By making a purchase, you agree to these Conditions of Sale.

1. Updates to the Terms of Sale

We may change these Terms of Sale from time to time, so we recommend that you check them regularly to stay informed of any updates. The most recent version of these Terms of Sale will always be available on the Website. Any new version of the Terms of Sale will come into effect immediately from the date of its publication and will govern any orders for products or services placed on or after that date. Any changes to the Terms of Sale made after you have placed an order will not affect that order or your relationship with us, except as required by applicable law.

2. Eligibility to Purchase

As a dealer in precious metals, gemstones or jewelry, the website is subject to the ASAE. Accordingly, ASAE regulations require Marco Cruz Joalheiro to adopt certain measures to prevent it from being used to facilitate money laundering or terrorist financing. Please be advised that Marco Cruz Joalheiro reserves the right to refuse to sell to any customer, especially any website customer, who does not comply with our internal compliance requirements. Furthermore, by placing an order through the website, you represent and warrant that you are a legitimate end customer, purchasing for your own personal use or that of a third party, and that you will not deliver, sell or otherwise distribute our products, nor will you purchase them for commercial purposes.

3. Product Availability and Quantity

All orders placed through the Website are subject to availability and acceptance by our team. In addition, certain products displayed may not be immediately available for sale and delivery. The Customer Relations Center will be able to provide further information regarding these products. Quantity limits may apply to orders of certain products. We reserve the right to refuse, at any time and without prior notice, any orders and/or orders exceeding a certain number of authorized products.

4. Prices, Taxes and Shipping Costs

All prices displayed on the product pages of the Website, if applicable, or quoted by the Customer Relations Center, are exclusive of sales tax, shipping costs and other taxes, unless otherwise indicated. Sales, use or other taxes will vary depending on the location to which the products are being shipped. We reserve the right to modify prices and delivery costs at any time without notice. We take reasonable care to ensure that product prices and delivery costs are correct at the time the relevant information is entered into the system. However, it is always possible that, despite our reasonable efforts, some of the products offered through the Website or the delivery costs may be incorrectly priced. In the event that any of the products you have ordered or the delivery costs are incorrectly priced, we will contact you as soon as possible to inform you of the error. If we are unable to contact you using the contact details provided during the ordering process, we reserve the right to cancel the order and notify you in writing. If we mistakenly accept and process your order, where a pricing or delivery cost error has occurred, we reserve the right to cancel delivery of the product and refund you for the amounts paid.

5. Shipping Times and Rates

We accept orders from all over the world and shipping times can vary from 2 to 15 business days, depending on the destination.

After we have placed your order, we will send you a written Order and Shipping Confirmation (by email). This Order and Shipping Confirmation constitutes our acceptance of your order and indicates the existence of a binding contract of sale. If delivery of the products is delayed by an event beyond our control, we will inform you as soon as possible and take reasonable steps to minimize the impact of the delay. If we fail to deliver within thirty (30) days from the date of the written Order and Shipping Confirmation or such other time period as we may specify, you may contact our Customer Service Center to cancel your order and obtain a refund of any amounts you have paid for products you have not received. In any event, your sole remedy for any failure by us to deliver your order shall be the right to cancel the order in question and receive a refund of the amounts you have paid for products you have not received. When estimating delivery times, please consider the time required for credit approval, address verification, security checks and order processing. Please note that delivery is always subject to receipt of full payment.

You, or a person at the stated delivery address (unless otherwise agreed by you), will be required to provide a handwritten or electronic signature to confirm delivery of each product, at which point the risk and liability for the products purchased will pass to you. If you have specified a recipient other than yourself for delivery purposes (for example, as a gift), you understand and accept that evidence of a signature by that recipient (or a person at the delivery address) will be considered as proof of delivery and fulfilment of the sales contract by Marco Cruz Joalheiro, as well as the transfer of liability to the recipient, in the same way as if the product had been delivered to you. We reserve the right to deliver products only to the person who is the stated recipient of the order, as stated on the order label, and to request identity verification for verification purposes at the time of delivery of the products. 6. Payment

We accept the payment methods identified as part of the ordering process on the website. Depending on the payment method, we may require additional information, including specific forms of identification and payment authorization forms.

You expressly authorise us to perform security checks, as we deem necessary and in accordance with our compliance programme, to transmit or obtain information (including any updated information) about you from or to third parties from time to time, including but not limited to your payment card details, to authenticate your identity, validate your debit/credit card, obtain an initial debit/credit card authorisation and authorise individual purchase transactions.

7. Returns and Exchanges

7.1. Website Return Policy

b) For any item you wish to return, please contact us by email or telephone.

Items may be accepted for credit or exchange if returned within 14 days of the order delivery date, accompanied by the invoice/receipt. Some exceptions may apply.

7.2. Website Return Process
a) We will check whether the returned product complies with the conditions of the website's Return Policy mentioned above and, if it complies, we will proceed with the applicable exchange or refund.

b) Our products must be returned in new and unused condition, in perfect condition, with all protective materials intact and labels and stickers attached (if applicable), as well as with the original Marco Cruz Joalheiro box and delivery packaging, including all accessories and documents. We reserve the right not to accept any return if the product shows signs of use or has been altered in any way from its original condition.

c) If you received free items (offers) as part of your order, these must be returned together with the products.

d) All returns will be subject to rigorous Quality Control (“QC”) by us to ensure that the returned products meet these requirements. If the products do not meet QC standards, we will refuse the return and the products will be returned to you. If the returned product meets QC standards, we will proceed with the applicable exchange.

You must keep proof of return shipment and we are not responsible if such proof cannot be provided. Notwithstanding anything to the contrary, this section does not apply to customized products. Certain products may be subject to a ten (10%) percent restocking fee.

7.3. Products that cannot be returned

Products purchased outside of the website and through other sales channels cannot be returned. Orders for products that have been customized in any way or made to your unique specifications cannot be canceled and such products cannot be returned for exchange or refund. This includes, without limitation, products that have been engraved.

7.4. Processing Time

Please allow 5-7 business days for your refund to be processed by your credit card company.

7.5. Refund Method

All returns will be processed to the original form of payment.

8. Repairs

8.1 Marco Cruz Joalheiro is pleased to offer cleaning and repair services for most of our products. Our services include:

  • Professional jewelry resizing, cleaning, polishing and repair;
  • Leather/other materials repair<./li>

8.2. Marco Cruz Joalheiro may refuse to offer cleaning or repair services in the event of previous repairs carried out by an unauthorized repair shop or service center.

8.3. To submit a repair request by mail, please click this link to email our support team so they can send you a shipping label for the repair.

8.4. Marco Cruz Joalheiro reserves the right to charge for services and repairs outside the warranty coverage.

8.5 Marco Cruz Joalheiro may retain the replaced part during service as its property, and the replacement part or product will become your property. If applicable law requires Marco Cruz Joalheiro to return the replaced part upon request, you agree to pay Marco Cruz Joalheiro the cost of selling the replacement item and shipping.

8.6. The Marco Cruz Joalheiro warranty must be presented with the products when they are sent for repair or maintenance.

9. Manufacturer's Warranty, Consumer's Legal Rights

9.1. We are committed to ensuring that each product strictly meets our quality criteria and has passed all our controls, both technical and aesthetic.

9.2. All products sold on the website are covered by Marco Cruz Joalheiro's lifetime warranty (the "Marco Cruz Joalheiro Warranty").

9.3. The Marco Cruz Joalheiro Warranty will be filled out and dated at the time of purchase.

9.4. Marco Cruz Joalheiro Warranty certificates with serial numbers that have been replaced, erased and/or made illegible are not eligible for warranty repairs. Failure to comply with the conditions of the Marco Cruz Joalheiro Warranty will render the warranty null and void. The Marco Cruz Joalheiro Warranty does not cover theft, loss or damage caused by accidental consequences (including drops, impacts, shocks and crushing), improper use, abuse, improper repairs carried out by an unauthorized repair shop/service center, or damage caused by natural disasters, extraordinary wear and tear of the jewelry and/or damage caused by humidity.

As a consumer, you may have legal rights under applicable legislation governing the sale of consumer goods; such legal rights are not affected by these Conditions of Sale or the applicable Marco Cruz Joalheiro Warranty.

10. Limitation of Liability

To the maximum extent permitted by applicable law, we disclaim and exclude all other terms, conditions and warranties relating to the products and Sales Channels, whether express or implied by law, or arising from any course of prior dealing, usage or trade practice. Nothing in these Conditions of Sale limits or excludes our liability for any liability that cannot be limited or excluded under applicable law.
Our total liability to you under these Conditions of Sale for any claim, whether in contract, tort (including negligence) or otherwise – even if we have been advised of the possibility of such damages – shall in no event exceed one hundred percent (100%) of the price of the product(s) in your order.
Please note that in some jurisdictions, consumer protection laws may not allow certain exclusions or limitations of warranties or liabilities, and accordingly some of the above exclusions and limitations may not apply to you.

11. General Provisions

11.1. If any provision, or part of a provision, of these Conditions of Sale is determined to be illegal, invalid or unenforceable, that provision or part-provision will be deemed not to form part of these Conditions of Sale, and the legality, validity or enforceability of the remaining provisions will not be affected, unless otherwise required by applicable law.

11.2. These Conditions of Sale (and the associated terms incorporated by reference) constitute the entire agreement between you and us in relation to the order of products or services, and supersede and cancel all previous agreements, draft agreements, arrangements, undertakings or ancillary contracts of whatever nature made by the parties, whether oral or written, relating to such subject matter. We shall not be liable for any failure or delay in performance of our obligations under these Conditions of Sale that results from any cause beyond our reasonable control.

11.3. The waiver by us of a breach of any provision of these Conditions of Sale will not be construed as a waiver of any other breach, whether prior or subsequent. This contract is between us and you. No other person shall have any right to enforce any of its provisions. However, if you purchase a product as a gift, the recipient of your gift will have the benefit of the applicable Marco Cruz Joalheiro Warranty.

12. Applicable Law and Jurisdiction

These Conditions of Sale are governed by and construed in accordance with the laws of Portugal, without prejudice to the mandatory provisions of the law of the country where you reside. Any dispute arising out of or in connection with these Conditions of Sale shall be subject to the exclusive jurisdiction of the Portuguese courts, unless otherwise provided by consumer protection legislation which may grant you the right to bring proceedings in the courts of your habitual domicile.

We will only retain your personal information for as long as necessary to fulfil the purposes for which it was collected, unless otherwise required or permitted by law. Once it is no longer needed, we will either securely destroy your personal information or anonymise it (so that the information can no longer identify you).

Please note that if your personal information is collected by a third party, it will be retained in accordance with that third party's privacy policies and record retention requirements.

14. Security of Your Personal Information

14.1. We implement technical and organizational measures to protect the information we collect from loss, misuse, unauthorized access, disclosure, alteration and destruction. These measures include physical, administrative and electronic (technological) security measures, which are reasonable considering the sensitivity of the personal information collected, the amount, distribution and format of the personal information, and the methods of storage. However, there is always a certain level of risk involved when personal information is collected, processed and stored, and we cannot guarantee the absolute security of your personal information.

You must take steps to protect unauthorized access to your password, phone, and computer by, among other things, signing out of your account after using a shared computer, choosing a strong password that no one else knows or can easily guess, and keeping your login information and password confidential. We are not responsible for lost, stolen, or compromised passwords or any activity on your account resulting from unauthorized activity using your password.
